With significant changes to the law on sexual harassment under the Employment Rights Act 2025, and the enhanced preventative duty increasing to all reasonable steps from October 2026, it is more important than ever for employers to ensure their training in this area is robust, up to date, and effective. The new framework strengthens employer obligations in respect of harassment and sexual harassment, including the return of liability for third party harassment, clarification that sexual harassment now constitutes a detriment for the purposes of whistleblowing claims, and tighter restrictions on the use of NDAs in cases involving harassment and discrimination.
